Terms of sales

The Shop is an e-commerce site accessible via the Internet at the address www.nextdose.fr/boutique. It is open to any user of this network. These conditions of sale are concluded:
– on the one hand, by self-publishers Guillaume Bousquières and Sébastien Iozzia, hereinafter referred to as “the seller”

– and on the other hand, by any natural or legal person wishing to make a purchase via the seller’s website, hereinafter referred to as “the buyer”.
 
  • Object
    These conditions of sale aim to define the contractual relations between the publisher and the buyer and the conditions applicable to any purchase made through the publisher’s merchant site.
    The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these general conditions of sale.
    These conditions of sale will prevail over any other general or specific conditions not expressly approved by the publisher.
    The publisher reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
  • Characteristics of the goods and services offered
    The products and services offered are those which appear in the catalog published on the publisher’s website.
    These products and services are offered while stocks last.
    The photographs in the catalog are non-contractual although they are as faithful as possible.
    All products and services are accompanied by a complete description.
  • Prices
    The prices appearing in the catalog are prices including tax, expressed in euros, taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products or services.
    The publisher reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
    The prices indicated do not include order processing, transport and delivery costs as long as they take place in the geographical areas provided below.
  • Geographical areas
    The online sale of products and services presented on the site is reserved for buyers who reside in France, in the French Overseas Territories, in Europe and in Quebec, and for deliveries required in these geographical areas.
  • Orders
    The buyer who wishes to purchase a product or service must:
    – add one or more items to the basket;
    – click on “View cart” to check the items present and indicate a delivery address to display the amount of shipping costs;
    – click on “Validate order” to provide the billing details and the delivery address (if different from the billing address);
    – complete the identification form on which he will indicate all the requested contact details or give his customer number if he has one;
    – choose the desired payment method (bank transfer, payment card, Paypal, etc.) and click on “Order”;
    – make payment under the conditions provided.
    Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and the waiver of taking advantage of one’s own conditions of purchase or other conditions.
    All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.
    The publisher will communicate by email confirmation of the registered order.
    If an item is pre-ordered, the order will be placed on hold and shipped when the pre-ordered item is available to ship.
  • Payment terms
    When registering the order, the buyer must pay the invoice in full, the balance to be paid before receipt of the goods. In the event of payment with a deposit, the buyer must pay the remaining balance before receipt of the goods.
    Payment must be made when ordering by the buyer. All orders are payable in euros.
    The buyer guarantees to the seller that he has the authorizations that may be necessary to use the payment method he chooses, when registering the order. The seller reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum which may be due by the buyer, in the event of payment incident or in the event of an existing dispute with the buyer.
    Payments will be made by credit card, through the secure Stripe system or Paypal depending on the buyer’s choice. These systems use the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can read it during transport on the network. In the event of payment by credit card, the buyer’s account will be debited on the day of the order.
    It is also possible to pay by bank transfer. In the event of payment by bank transfer, the buyer must provide the elements necessary to identify their payment in relation to the order placed (order number to be indicated in the transfer reference). Useful information for making the bank transfer is mentioned when choosing payment.

  • Delivery and reception
    The products will be delivered to the address indicated by the buyer during validation of the order, a destination which must be consistent with the geographical area previously agreed. By default, invoices are sent to the email address indicated by the buyer during registration. Failure to comply with the procedures set out below will result in no complaints from the buyer being accepted. Shipping costs include packaging, handling and postage. They may contain a fixed part and a variable part depending on the price or weight of your order.
    Your package is shipped at your own risk, special care is taken with packages containing fragile products. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.
    Delivery times are given for information purposes only. If these exceed thirty days from the order, the sales contract may be terminated and the buyer will be reimbursed.
  • Guarantee
    All products supplied by the seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code.
    In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or reimburse it.
    All complaints, requests for exchange or refund must be made by email to contact@nextdose.fr specifying the order number and the title of the product concerned.
  • Withdrawal
    In accordance with article L. 121-20 of the Consumer Code, the Buyer has a period of fourteen clear days from the date of receipt to return the ordered products at their own expense for reimbursement. The products must be returned to in perfect resalable condition, in their original condition (packaging, accessories, etc.), duly sealed, and accompanied by the return number obtained according to the procedure described in the article below . When a buyer returns products, any risk associated with returning the product is the buyer’s responsibility.
    Any unpacked, damaged or incomplete product cannot be returned based on the right of withdrawal.
    Likewise, withdrawal only concerns material goods (for example: books printed on paper), but does not concern intangible goods (for example: e-books, computer files, etc.).
    Reimbursement will be made using the same means of payment as that initially used by the buyer, unless the buyer expressly agrees to use another means of payment and to the extent that reimbursement does not entail additional costs.
    If the aforementioned conditions are met, the seller will reimburse the buyer, within fourteen days, the sums corresponding to the products purchased by him, with the exception of return costs remaining the responsibility of the buyer.
  • Returning a product by mail/parcel
    To return a product, the buyer must first contact the seller to obtain a return number and the return address. He can do it by email to contact@nextdose.fr specifying the order number and the title of the product concerned. Once the return number has been obtained, the buyer will send the package concerned to the return address indicated by the seller.
    The seller will not accept any return package if it is not accompanied by a return number. The seller will also not accept parcels sent postage collect. Failure to comply with the procedure set out above and the deadlines indicated previously, the buyer will not be able to make any claim for non-conformity or apparent defect of the products delivered, the products being then deemed to be compliant and free from any apparent defect.
  • Force majeure
    The seller’s liability cannot be implemented if the non-execution or delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure. As such, force majeure means any external, unpredictable and irresistible event within the meaning of article 1148 of the Civil Code.
  • Responsibility
    The seller, in the online sales process, is only bound by an obligation of means. It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, interruption of service, or other unintentional problems.
  • Intellectual property
    All elements of the site www.nextdose.fr are the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound.
  • Court of competent jurisdiction
    Any dispute relating to the interpretation and execution of these general conditions of sale is subject to French law.
    Failing an amicable resolution, the dispute will be brought before the Castres Commercial Court.
